1. Who may use the website, app and web player

The app and web player are intended for users aged 18 or over. You must not create an account or use account features if you are under 18.

Some content may be age-restricted or age-related. To listen to age-restricted or age-related content in the app or web player, you may be required to create an account, sign in, and confirm that you are 18 or over.

Sport Social Podcast Network is not designed for, directed at or targeted towards children. Some podcast content may include mature themes, strong language, sports debate, gambling references or other material that may be unsuitable for younger listeners.

If you are a parent or guardian, you are responsible for deciding whether any content accessed through the website, app or web player is suitable for a child in your care.

2. What the website, app and web player provide

The website provides information about Sport Social Podcast Network, including our podcast network, shows, news, services, studios, advertising opportunities, rights-holder services, podcaster services and ways to contact us.

The app and web player allow users to discover, stream, queue, save, manage and listen to podcasts and related audio content in one place.

The website, app and web player may include:

a. podcasts hosted on or distributed through Sport Social Podcast Network; b. podcasts made available by Sport Social Podcast Network partners, publishers, clubs, creators, rights holders or advertisers; c. podcast feeds or episodes added by you from third-party podcast hosting platforms or other external providers; d. podcast titles, descriptions, artwork, metadata, episode lists and categories; e. playback, queueing, saving and account-management features; f. downloads or offline listening where available; g. recommendations, search, discovery and editorial features; h. enquiry forms, contact forms, surveys and similar website features; i. information for podcasters, advertisers, rights holders and commercial partners; and j. advertising, sponsorship or promotional content.

Some features may require an account, internet access, a compatible device and the latest available version of the app, browser or operating system.

Access to age-restricted or age-related content may require an account, sign-in and confirmation that you are 18 or over.

The app and web player are provided free of charge and primarily for personal podcast listening.

3. Your account

Some app or web player features require an account. This may include access to age-restricted or age-related content, saving preferences, managing playback, downloads or offline listening, and other account-based features.

You must provide accurate information when creating or updating an account. If you are asked to confirm your age, you must answer truthfully.

You are responsible for keeping your sign-in details secure and for activity carried out through your account, unless the activity is caused by our failure to use reasonable care.

You must tell us promptly if you believe your account has been accessed without permission.

We may refuse, suspend or close an account where we reasonably believe that:

a. the account has been created or used in breach of these Terms; b. the account is being used unlawfully, fraudulently or abusively; c. the account creates a security, technical, legal or rights risk; d. the user is under 18 or has provided false age-confirmation information; or e. we are required to do so by law, regulation, platform rule, court order, rights-holder request or competent authority.

Where reasonably possible, we will explain the reason for suspension or closure unless doing so would create a legal, security, fraud prevention, safety or rights-enforcement risk.

4. Acceptable use

You must use the website, app and web player lawfully and responsibly.

You must not:

a. use the website, app or web player for any unlawful, fraudulent, harmful or abusive purpose; b. copy, extract, scrape, redistribute, sell, rent, sublicense, broadcast or commercially exploit content from the website, app or web player without permission; c. remove, alter, bypass or interfere with rights management, advertising, sponsorship, attribution, measurement, security or technical controls; d. attempt to gain unauthorised access to the website, app, web player, user accounts, systems, networks, data or content; e. introduce viruses, malware, malicious code, bots, automated scraping tools or other harmful technology; f. reverse engineer, decompile, disassemble or attempt to derive source code from the app or web player except where permitted by law; g. impersonate another person or misrepresent your identity or affiliation; h. interfere with another user’s enjoyment of the website, app or web player; i. use the website, app or web player in a way that could damage Sport Social Podcast Network, Communicorp UK, our partners, creators, advertisers, rights holders or other users; j. submit false, misleading, unlawful, harmful, abusive or infringing information through any contact form, survey, enquiry route or account feature; k. provide false age-confirmation information, allow a person under 18 to use your account to access age-restricted or age-related content, or attempt to bypass any age-gating, sign-in or access-control measures; or l. use the website, app or web player in breach of any app store, operating system, device, browser or third-party platform rules that apply to you.

5. Website content and commercial information

The Sport Social Podcast Network website may include information about our podcast network, shows, services, studios, advertising opportunities, rights-holder services, podcaster services, news, case studies, audience statistics, downloads, streams, awards, surveys and other commercial or editorial information.

We take reasonable care to keep website information accurate and up to date, but website content is provided for general information only. It is not legal, financial, commercial, technical or professional advice.

Any audience figures, download figures, stream figures, campaign information, rankings, awards, testimonials, examples or case studies are provided to describe Sport Social Podcast Network and its services. They should not be treated as a guarantee of future performance, audience delivery, revenue, campaign results or availability.

Any proposal, campaign, production service, advertising booking, sponsorship, podcast hosting arrangement, rights-holder arrangement or other commercial relationship will be subject to separate written terms agreed with the relevant party.

6. Enquiries, forms and surveys

The website, app or web player may allow you to contact us, submit enquiries, complete surveys, request information, register interest, or provide details about yourself, your organisation or your podcast.

You must ensure that any information you submit is accurate, lawful and not misleading.

Submitting an enquiry, form or survey does not create a contract, partnership, agency relationship, employment relationship, advertising booking, sponsorship agreement, production agreement, hosting agreement, distribution agreement or rights-holder agreement.

We may use information submitted through forms and surveys to respond to your enquiry, administer our services, understand our audience, improve our products, and otherwise as explained in our Privacy Policy.

We are not required to respond to every enquiry or accept every proposal, podcast, advertiser, sponsor, rights holder, publisher or commercial opportunity.

7. Podcast content on Sport Social Podcast Network

Sport Social Podcast Network hosts, distributes, indexes or provides access to podcast content created by Sport Social Podcast Network, partner publishers, clubs, rights holders, advertisers, independent podcasters and other third parties.

Unless content is created by us, the creator, publisher or supplier of that content is responsible for:

a. its accuracy, opinions and claims; b. securing all necessary rights, permissions, licences and clearances; c. complying with applicable laws and regulatory requirements; d. applying appropriate explicit-content markers, content warnings and classifications; and e. ensuring that the content does not infringe third-party rights.

Views expressed in podcasts are those of the relevant creators, hosts, guests or contributors and do not necessarily represent the views of Sport Social Podcast Network, Voiceworks (Sport) Limited or Communicorp UK.

We do not guarantee that all podcast content will be accurate, complete, up to date, suitable for a particular listener, or available at all times.

8. Podcasts added from third-party providers

The app or web player may allow you to add, follow, save or listen to podcasts from third-party hosting platforms, external podcast feeds or other providers that are not controlled by Sport Social Podcast Network.

Where you add or access third-party podcast feeds:

a. the relevant third-party provider, publisher, creator or rights holder remains responsible for the content; b. availability, playback, metadata, artwork, descriptions, episode lists and feed information may depend on that third party; c. we may not control the accuracy, legality, suitability, reliability or availability of that content; d. third-party feeds may change, stop working, be restricted or be removed without notice; and e. your use of that content may also be subject to the terms, privacy policy and rights notices of the relevant third-party provider.

We may remove, disable, restrict or stop supporting access to a third-party feed or item of content where we reasonably believe this is necessary for legal, rights, safety, technical, editorial, security, platform-rule or operational reasons.

9. Mature, explicit and sensitive content

Some podcasts may contain mature themes, strong language, adult discussion, sports debate, gambling references, alcohol references, mental health discussion, violence references, combat sports discussion or other content that may be unsuitable for some listeners.

Some content may be marked, treated or made available as age-restricted or age-related content. Access to that content may require you to create an account, sign in, and confirm that you are 18 or over.

An explicit-content marker, warning, category, description or absence of a marker is not a guarantee that content will or will not be suitable for you.

You are responsible for choosing what you listen to and for ensuring that anyone using your device, account or app access is permitted to access the content made available through it.

10. Gambling references

Some sports podcasts may discuss betting odds, gambling markets, fantasy sports, horse racing, sponsorship, advertising or betting-related topics.

The website, app and web player are not betting services. We do not provide gambling services through the website, app or web player.

Any gambling-related links, promotions or references are subject to applicable laws, advertising rules, platform rules and the terms of the relevant third-party provider.

You must be 18 or over to gamble in the UK. Please gamble responsibly.

11. Downloads and offline listening

Where downloads or offline listening are available, they are provided only for personal listening within the app or web player.

You must not copy, extract, transfer, distribute, sell, edit, upload, publish or use downloaded content outside the app or web player.

Downloaded content may become unavailable, expire or be removed if:

a. the content is withdrawn; b. rights or licences change; c. your account is closed or suspended; d. you uninstall the app or change device; e. the app is updated; f. a third-party feed changes or becomes unavailable; g. technical issues occur; or h. we are required to remove or restrict access.

12. No public user posting or user-to-user features

The website, app and web player are designed for browsing, listening, discovery, enquiries and account management.

The website, app and web player do not allow users to upload podcast content for publication through the app, post public comments, send public messages, create public profiles, or otherwise interact publicly with other users through the app.

If the website, app or web player changes in future to include uploads, public posting, creator submission tools, comments, messaging or other user-to-user features, additional terms, policies or safety processes may apply.

13. Reporting content, rights or account concerns

You may contact us if you believe content available through the website, app or web player:

a. has been incorrectly classified; b. lacks an appropriate explicit-content marker or warning; c. infringes rights; d. is unlawful; e. is harmful or unsuitable; f. breaches these Terms; or g. raises another legal, safety, safeguarding, privacy or content concern.

Where appropriate, we may review the report and take reasonable action. This may include contacting the creator, publisher, rights holder or third-party provider, asking for corrections, adding or requesting warnings, restricting availability, disabling access, removing content, preserving evidence, notifying a platform or authority, or taking no action where we reasonably conclude that no action is required.

14. Advertising, sponsorship and commercial content

The website, app, web player and podcast content may include advertising, sponsorship, host-read advertising, promotional messages, affiliate links, branded content or other commercial material.

Advertising may be delivered, measured or supported by us, creators, publishers, advertisers, agencies, podcast hosting platforms, analytics providers or other partners.

You must not block, remove, alter, bypass or interfere with advertising, sponsorship, attribution or measurement technology, except where you are using ordinary device, operating system or browser settings made available to users.

Information on the website about advertising, sponsorship or commercial opportunities is provided for general information only and does not guarantee availability, pricing, audience delivery, campaign performance or acceptance of any booking.

16. App stores and device platforms

If you download or access the app through Apple, Google or another app store or platform, the app store or platform terms may also apply.

Those terms are between you and the relevant app store or platform provider. We are responsible for the app as between you and us, but the app store or platform provider may have its own rights, rules and responsibilities.

You must comply with all applicable app store, operating system and device rules when using the app.

17. Intellectual property

All intellectual property rights in the website, app, web player, service design, software, branding, logos, trade marks, interfaces, databases, text, graphics, artwork, metadata and other materials made available by us belong to us or our licensors.

Podcast and audio content belongs to the relevant creator, publisher, rights holder or licensor.

You are granted a personal, limited, revocable, non-exclusive, non-transferable licence to access and use the website, app and web player for lawful personal, non-commercial browsing, listening, enquiry and account-management purposes in accordance with these Terms.

No rights are transferred to you except as expressly stated in these Terms.

You must not use Sport Social Podcast Network, Voiceworks, Communicorp UK or third-party names, logos, trade marks, branding, artwork or content without permission, except where permitted by law.

18. Service changes and availability

We aim to provide a reliable service, but we do not guarantee that the website, app, web player, content or any feature will always be available, uninterrupted, secure or error-free.

We may update, change, suspend, withdraw or restrict the website, app, web player, content, features, account functionality, downloads, supported devices or supported platforms where we reasonably need to do so, including for legal, technical, operational, security, editorial, commercial, rights-related or platform-rule reasons.

We may also remove, hide, restrict or update content where required by law, rights restrictions, technical issues, partner requests, creator requests, platform rules, advertiser requirements, editorial decisions or our internal policies.

Where a change materially affects your use of the app or web player, we will try to give reasonable notice where practical.

19. Updates to the app and web player

We may make updates available to improve performance, security, compatibility, compliance or functionality.

Some features may not work correctly if you do not install the latest available version of the app or if your device, operating system, browser or network is no longer supported.

20. Privacy and cookies

We process personal data in accordance with our Privacy Policy.

We use cookies and similar technologies in accordance with our Cookie Policy and any choices you make through our cookie or consent tools.

The website, app and web player may use strictly necessary technologies for security, sign-in, playback, age-gating, account access and core functionality. Optional analytics, advertising or personalisation technologies will be used where required consent has been obtained, unless an exemption applies.

21. Notifications and preferences

The app or web player may allow you to receive service notifications, content alerts, account messages, marketing communications or other updates.

You can manage certain notification and communication preferences through the app, web player, your device settings, unsubscribe links or by contacting us.

Some service or account messages may still be sent where necessary to operate the website, app or web player, protect security, manage your account, manage age-gated access or comply with legal obligations.

22. Our responsibility to you

We do not exclude or limit our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, and any rights you have under consumer protection law that cannot be excluded.

We are not responsible for:

a. loss or damage that was not foreseeable; b. loss or damage caused by your breach of these Terms; c. business losses, including loss of profit, revenue, business, contracts, goodwill or business opportunity, because the website, app and web player are provided for public, personal and general informational use unless otherwise agreed in a separate written commercial agreement; d. content created, supplied, hosted, distributed or controlled by third parties, except where the law says we are responsible; e. failures caused by events outside our reasonable control; f. third-party podcast feeds becoming unavailable, inaccurate, incomplete or unsuitable; g. commercial decisions made by you based only on general website information without a separate written agreement; or h. incompatibility caused by your device, operating system, network, browser, settings or failure to install available updates.

Nothing in these Terms affects your statutory rights.

23. Your responsibility to us

You are responsible for losses we suffer where those losses arise from your unlawful use of the website, app or web player, your breach of these Terms, or information you submit in breach of these Terms.

This does not make you responsible for loss or damage caused by us, by events outside your reasonable control, or by your lawful use of the website, app or web player in accordance with these Terms.

24. Suspension and termination

You may stop using the website, app or web player at any time. You may also contact us to request account closure.

We may suspend, restrict or end your access to the website, app, web player or any feature where we reasonably believe that:

a. you have breached these Terms; b. your use creates a legal, safety, security, rights, fraud, technical or operational risk; c. you have provided false age-confirmation information or allowed a person under 18 to access age-restricted or age-related content through your account; d. we are required to do so by law, regulation, court order, platform rule or competent authority; e. a rights holder, creator, partner, publisher or platform requires removal or restriction; or f. the service or feature is being withdrawn.

Where reasonably possible, we will give you notice before or after taking action, unless doing so would create a legal, safety, security, fraud prevention, rights-enforcement or operational risk.
